Hate speech laws are spreading in Europe as EU governments and international organisations try to find measures to defuse conflicts. At first sight, these laws seem to foster a civilised discourse, but free speech advocates, journalists and lawyers warn of excessive limitations of this most basic human right. Germany has recently passed a hate speech law that fines companies up to €50 million if they don’t remove “hateful” content in good time. It remains unclear, however, what exactly qualifies as “hateful” and who defines it. Politicians, the clergy and everyday citizens have been prosecuted for “hate speech”. Last year, Dutch MP Geert Wilders was convicted for inciting discrimination against Dutch Moroccans. He called the prosecution a lawsuit against freedom of speech. The European Court of Human Rights upholds strong protections for speech, even if it “shocks, offends or disturbs”. Is Europe moving away from that position and towards laws that stifle rather than encourage debate and expression? If freedom of expression means that only the politically correct is protected, it is not a freedom worth having. On the other hand, how far can and should freedom of expression go? EURACTIV organised this Forum to discuss the current challenges on freedom of expression. Questions included: - How is freedom of expression being endangered today? - What is the nature and intention of hate speech laws? - How to deal with hatred in the media while defending freedom of expression? - How far should freedom of expression go? What are the limits of acceptable speech?

Section 16 of the Constitution protects freedom of expression. Expression includes words and other expressive activities. The right also protects ideas that will offend or disturb people and therefore includes a duty to be tolerant of others. The Courts ultimately decide what kind of expression the Constitution prohibits. Freedom of Expression includes the right to receive information and unrestricted ideas. One of the goals of protecting these rights is to promote open, responsive and accountable governance. The right to freedom of expression is limited in some circumstances – as long as the limits are reasonable and justifiable in an open and democratic society. Hate speech challenges the dignity of others and causes harm and is not protected by the Constitution. Section 16 outlines different forms of hate speech which The Promotion of Equality and Prevention of Unfair Discrimination Act elaborates on. You can use the Equality Court to challenge hate speech and the Court can make a variety of orders.

Dr. Jordan Peterson is being disciplined by the College of Psychologists of Ontario for public comments he has made on social media and on podcasts. While controversial, these comments do not relate to the practice of psychology. Dr Peterson has applied for a judicial review challenging the constitutionality of the provisions of the College’s Code of Ethics and Professional Standards that were relied on to order this discipline. In this video, CCF lawyer Christine Van Geyn explains Dr. Peterson's case against the College of Psychologists. The Canadian Constitution Foundation is considering intervening in Dr. Peterson’s case to make submissions on the value of freedom of expression. We have not yet applied for leave to intervene. This right has been lost in Myanmar, where people have been arrested this year just for liking an opposition post on Facebook. The UN Declaration of Human Rights is commemorated every 10th December. To highlight some of the multiple human rights violations taking place in Myanmar since the military coup, Doh Athan has created some short videos. The prestigious Journalists Club of Mexico on December 7th announced the results of its 70th annual National and International Journalism Competition, presenting its awards to journalists selected by an independent jury. The Schiller Institute and its founder Helga Zepp-LaRouche received the Freedom of Expression award, which back in 2019 had been conferred on Julian Assange. This year, Daria Dugina, the Russian journalist who was killed in a terrorist attack outside Moscow back in August, was given a posthumous award received on her behalf by the Russian ambassador to Mexico. The ceremony began with the Mexican national anthem. Jesús Ramírez Cuevas, press spokesman of the Mexican presidency brought greetings from President López Obrador to the gathered journalists, diplomats and other guests. And the leaders of the Journalists Clubs added their voice to the international demand for peace and an end to war, and against the assassinations and threats by groups such as Ukraine’s CCD.

Prove They Are Alive is a campaign to protect the rights of a large number of detainees serving long-term sentences in Turkmen prisons. It is one of the nominees in Index on Censorship's Freedom of Expression 2020 Awards in the campaigning category The campaign was launched in 2013 with the goal of promoting work to defend human rights in Turkmenistan. Enforced disappearances of people sentenced to long prison terms is one of the most acute human rights violations in Turkmenistan. Prove They Are Alive! has documented 120 cases of this practice going back to the 1990s, and continues to report on those who remain disappeared. The organisation has been instrumental in raising global awareness for the disappeared. Thanks to significant pressure from Prove They Are Alive, ex-prisoners are now more likely to be allowed to leave the country and, astonishingly, over a dozen disappeared prisoners have been granted visitation rights.
Freedom of expression is a fundamental right, indispensable in democratic societies. However, this right is not an absolute right, and may be lawfully restricted according to certain principles and conditions. Under international human rights law, and specifically, article 19 of the International Covenant on Civil and Political Rights (ICCPR), the three-part test determines whether a restriction on freedom of expression is legitimate. OKO Press is the one of the first free investigative journalism and fact-checking website in Poland. It is one of the nominees in Index on Censorship's Freedom of Expression Awards 2020 in the Journalism category. They investigate and evaluate statements made by politicians, monitor public spending, and fight for access to public information. Their work also supports grassroots activism; crucial in an environment sliding further and further into authoritarianism and censorship. OKO Press have paved the way for other news sources to follow suit. This has contributed to a safer and stronger public sphere, fighting for immunity from government propaganda. The environment in which they work is becoming increasingly hostile. Political polarisation, lack of transparency, suspicion, threats and withholding of information are common. In the face of this, OKO Press shows resilience and determination.
